What Maine Homebuyers Should Investigate Before Buying a Pre-1978 Property
A traditional home inspection can tell you a great deal about a house.
It can reveal problems with the roof, foundation, electrical system, plumbing, heating equipment, drainage, structure, and many of the other components that matter when you are deciding whether to buy a property.
But a traditional home inspection does not tell the full story.
It may not tell you whether the old painted windows contain lead-based paint.
It may not tell you whether flooring, insulation, siding, pipe insulation, or other suspect materials contain asbestos.
It may not tell you whether the air contains elevated radon.
Those are different questions.
And for buyers considering an older Maine home - particularly a property built before 1978 - those questions can become extremely important for buyers in due diligence.
That distinction matters.
Because there is a major difference between discovering an environmental condition while you still have contractual options available to you and discovering it six months after you own the property.
For many buyers, environmental due diligence should not replace the traditional home inspection.
It should complement it.
The traditional home inspection answers one set of questions.
Environmental testing answers another.
Together, they can provide a much clearer picture of what you're actually buying.
Maine Buyers Are Purchasing Some Very Old Houses
One of the things that makes Maine real estate so appealing is also one of the things that makes due diligence so important:
We have an extraordinary inventory of older housing.
Throughout Southern Maine, it is common to purchase homes constructed in the:
1700s,
1800s,
early 1900s,
1920s,
1940s,
1950s,
1960s,
and 1970s.
Portland.
South Portland.
Westbrook.
Biddeford.
Saco.
Scarborough.
Falmouth.
Cape Elizabeth.
Lewiston.
Auburn.
And virtually every older town and neighborhood in between.
These homes can be beautiful.
They can be incredibly well built.
They can have craftsmanship and architectural character that would be extraordinarily expensive to reproduce today.
But older construction also means older building materials.
And that changes the due-diligence conversation.
If you're purchasing a house constructed before 1978, the possibility of lead-based paint should be part of the discussion.
If you're planning renovations in an older building, asbestos-containing materials may also be relevant.
And regardless of the age of the home, radon should be considered.
None of this means older homes are bad homes.
It means older homes deserve due diligence appropriate to their age.
The Traditional Home Inspection Has a Different Job
This distinction is important because I have tremendous respect for professional home inspectors.
A good home inspector may be one of the most valuable professionals involved in a real estate transaction.
Their job is broad.
They are looking at the physical condition and performance of the property.
They may evaluate:
roofing,
siding,
foundations,
framing,
electrical systems,
plumbing,
heating systems,
cooling systems,
ventilation,
drainage,
insulation,
windows and doors,
decks and porches,
attics,
basements,
crawlspaces,
and dozens of other components.
That is already an enormous scope.
But environmental inspection and testing is different.
A home inspector may observe deteriorated paint. That does not necessarily tell you whether that paint contains lead.
A home inspector may identify old resilient flooring. That does not tell you whether the flooring or underlying adhesive contains asbestos.
A home inspector may recommend radon testing. But unless professional radon measurement is actually conducted, the radon concentration remains unknown.
The important question for buyers isn't:
“Did my home inspector miss something?”
The better question is:
“Am I asking each professional to answer the questions they are actually qualified and equipped to answer?”
That is a much better due-diligence model.
Why 1978 Matters
Lead-based paint was used extensively in American housing for decades.
Federal regulations banned the residential consumer use of lead-based paint in 1978.
That means when you're purchasing a pre-1978 property, especially one with original painted building components, lead should at least be part of the conversation.
Older windows are particularly important.
Think about what happens when a painted double-hung window is opened and closed repeatedly. Painted surfaces rub against each other. Friction occurs. Paint can deteriorate. Dust can be created.
The same principle applies to other friction and impact surfaces throughout older homes.
The condition of the paint matters.
But knowing whether the paint actually contains lead can materially change how you approach:
renovation,
window replacement,
paint preparation,
repair work,
contractor selection,
containment,
cleanup,
budgeting,
and future maintenance.
A visual inspection alone cannot answer that question.
XRF testing can.
Lead-Based Paint: The Question Isn't Just “Is There Lead?”
One of the misconceptions about lead inspections is that the only useful answer is whether the house is “positive” or “negative.”
For many older Maine homes, that's too simplistic.
A more useful question may be:
Where is the lead?
A component-by-component XRF inspection can provide considerably more useful information.
Instead of simply telling a buyer that an older home may contain lead-based paint, testing can help identify which painted components test positive and which do not within the scope of the inspection.
For example:
living-room window sash — positive,
kitchen door casing — negative,
bedroom baseboard — negative,
stair railing — positive,
exterior porch column — positive.
Now the buyer has information they can actually use.
That can become particularly important if renovation is planned.
If you're going to replace eight original windows immediately after closing, knowing whether those specific windows contain lead can affect the renovation plan.
If you're planning to strip painted trim, remodel a room, alter painted surfaces, or hire contractors, knowing what you're working with before the project begins can be extremely valuable.
Families With Young Children Should Pay Particular Attention
Lead exposure is especially important for families with young children.
Children under six are particularly vulnerable because their bodies and nervous systems are still developing, and normal childhood behavior can increase exposure risk.
Young children spend time on floors.
They touch windowsills.
They put their hands and objects in their mouths.
They generate a lot more contact with household dust than adults realize.
This does not mean that every pre-1978 home is unsafe for children.
It means that families purchasing older housing may benefit from having more information before taking ownership.
If you currently have children under six - or you're planning to grow your family in the future - the question becomes:
Would you rather know where lead-based paint is located before you purchase the property or discover it later?
That information can help you make more informed decisions about maintenance, renovation and occupancy.
Renovation Changes the Equation
A painted surface that remains intact and undisturbed is one conversation.
A painted surface that you're planning to demolish, cut, sand, scrape or replace is another.
The same is true for asbestos-containing materials.
A buyer may walk through an older home and see:
old kitchen flooring,
basement pipe insulation,
plaster,
ceiling texture,
wall systems,
siding,
roofing materials,
floor tile,
adhesive,
heating-system materials,
or other older building products.
Many materials cannot be reliably identified as asbestos-containing simply by looking at them.
Laboratory analysis is often required.
And that becomes extremely relevant if those materials are going to be disturbed.
If you're buying a home and planning a major kitchen renovation immediately after closing, the environmental question isn't abstract.
It can directly affect:
demolition procedures,
contractor scheduling,
disposal,
abatement requirements,
project sequencing,
renovation cost,
and your overall budget.
This is why targeted asbestos sampling tied to planned renovations can be so valuable during due diligence.
The goal is not necessarily to sample every suspect material in the entire building.
The goal is to answer the questions that matter to your intended use of the property.
Targeted Asbestos Testing: Test What You Plan to Disturb
For a buyer, a targeted asbestos inspection can be especially useful when renovation plans are already known.
Suppose you know before closing that you intend to:
remodel the kitchen,
remove old flooring,
demolish a bathroom,
replace basement heating equipment,
disturb pipe insulation,
remove siding,
alter ceilings,
or renovate an older finished basement.
Those planned disturbance areas can be evaluated.
Suspect materials can be identified.
Appropriate bulk samples can be collected.
Laboratory analysis can determine whether asbestos is present in the sampled materials.
Now the renovation budget is being built around actual information instead of assumptions.
That is environmental due diligence.
Radon Is Different — Because You Can't See It
Lead may be associated with paint.
Asbestos may be associated with building materials.
Radon is different.
You cannot see it. You cannot smell it.
You cannot walk through the basement and determine the radon concentration by looking around.
Radon is a naturally occurring radioactive gas that can enter buildings from the soil beneath and around them.
The only way to know the concentration in a particular home is to test.
That is why radon measurement belongs in the due-diligence conversation.
A professional radon test can document the radon concentration under the prescribed testing conditions.
If an elevated result is identified, buyers can then evaluate mitigation options and associated costs before closing.
Again, the objective isn't fear. It's information.
Radon mitigation is common.
What matters is knowing whether it should become part of the ownership plan.
Three Different Environmental Questions
When I think about environmental due diligence for an older Maine property, I generally separate the conversation into three different questions.
1. Lead
Which painted components contain lead-based paint?
For a pre-1978 home, XRF testing can help answer that question without requiring destructive paint-chip sampling of every component.
2. Radon
What is the radon concentration in the home under the testing conditions?
Professional radon measurement provides data instead of assumption.
3. Asbestos
Do the suspect materials associated with planned renovations contain asbestos?
Targeted inspection and laboratory sampling can help answer that question before demolition begins.
Those are three very different questions.
They require different equipment, different methods and different scopes.
But together, they can dramatically reduce uncertainty for the buyer.
Why Timing Matters So Much
There is a small window in a real estate transaction when buyers may still have significant contractual options available.
That is the due-diligence period.
Once the transaction closes, the situation changes.
The house is yours.
The renovation costs are yours.
The mitigation costs are yours.
The unknowns become your unknowns.
That doesn't mean every environmental discovery before closing will result in a seller concession.
It won't.
But discovering information while you still have options is fundamentally different from discovering it afterward.
This is why I believe the timing of environmental due diligence matters almost as much as the testing itself.
The best information is information you receive while you can still do something with it.
Environmental Due Diligence Is Not About Scaring Buyers
There is an important misconception I want to address.
Environmental inspection should not be about creating fear around older homes.
Quite the opposite.
Information can make older homes easier to understand.
If testing identifies lead-based paint on four original windows but the remainder of the tested interior components are negative, that's useful information.
If targeted asbestos sampling determines the flooring you plan to remove is negative, that's useful information.
If radon testing comes back below the applicable action level, that's useful information.
And if testing identifies conditions that require management, mitigation or additional planning?
That's useful too.
The purpose is not to label the house “good” or “bad.”
The purpose is to reduce uncertainty.
Realtors Shouldn't Be Environmental Consultants
The real estate agent has an incredibly important role in the transaction.
But the agent should not be expected to determine whether something contains lead.
They should not be expected to identify asbestos by sight.
They should not be expected to interpret radon data outside the appropriate professional context.
And the environmental inspector shouldn't be giving legal advice or telling the buyer how to negotiate the real estate contract.
Each professional has a different job.
The agent's job should remain the agent's job.
But recommending appropriate specialty inspections can help buyers answer material questions while they still have contractual due-diligence options available to them.
That creates a much healthier conversation:
Home Inspector: Here is the physical condition of the house.
Environmental Inspector/Test Provider: Here are the environmental findings within the agreed scope.
Contractor: Here is what remediation, management or renovation may cost.
Realtor: Here are your contractual options and how we can structure the conversation with the seller.
Buyer: Now I can make an informed decision.
Everyone stays in their lane.
But the buyer gets a much clearer picture.
Environmental Findings Don't Automatically Mean “Walk Away”
This may be the most important point of the entire article.
I am not looking for reasons to kill real estate transactions.
I'm looking for information.
A positive lead result does not automatically mean you shouldn't buy the house.
A suspect material testing positive for asbestos does not automatically mean you shouldn't renovate.
A radon result above the recommended action level does not automatically make the home uninhabitable.
These conditions frequently have established management or mitigation strategies.
The real problem is discovering them after you buy.
Imagine two scenarios.
Buyer A
Buys an older house.
Closes.
Six months later decides to replace the windows and remodel the kitchen.
Only then discovers lead-based paint and asbestos-containing material that change the renovation scope and cost.
Buyer B
Performs environmental due diligence during the inspection period.
The buyer knows which painted components contain lead.
The flooring scheduled for demolition has been tested.
The radon level is documented.
Contractors can provide realistic estimates.
The buyer and agent can evaluate those costs before the purchase is finalized.
Same house.
Very different information position.
Environmental Due Diligence Can Become Negotiating Information
This is where the financial value becomes easier to understand.
Suppose you're purchasing a $550,000 Southern Maine home.
Your environmental testing identifies:
several lead-positive original windows scheduled for replacement,
asbestos-containing flooring beneath the kitchen floor scheduled for demolition,
and elevated radon requiring mitigation.
That doesn't automatically mean the seller owes you anything.
Negotiations depend upon the contract, market, seller, property and advice of your real estate professionals.
But now you have documented information.
Instead of saying:
“We're worried there might be environmental issues.”
you may be able to say:
“Testing identified these specific conditions. Here are the reports. Here are the areas affected. Here are the contractor estimates associated with our planned work.”
That can provide the buyer and their agent with a much stronger factual foundation for evaluating:
a purchase-price adjustment,
seller credit,
specific repairs or mitigation,
contractor estimates,
revised renovation budgets,
or whether to proceed with the transaction at all.
Environmental testing doesn't create the negotiation.
It improves the information behind the negotiation.
The Cost Question: Is All This Testing Worth It?
This deserves complete transparency.
Environmental inspections cost money.
Depending on the size of the home, number of painted components, number of asbestos samples, laboratory charges and radon testing requirements, comprehensive environmental due diligence can easily represent four figures of additional inspection expense.
That's real money.
But context matters.
If you are preparing to spend:
$400,000
$600,000
or
$1,000,000
on a property - and potentially tens or hundreds of thousands more renovating it—the question becomes:
What is the value of reducing uncertainty before you own it?
For example, a buyer might separately invest in:
a comprehensive XRF lead inspection,
professional radon measurement,
targeted asbestos inspection and laboratory analysis.
For a typical Southern Maine home, the combined investment can often represent a very small fraction of the property's purchase price.
That does not guarantee that expensive conditions will be discovered.
And it does not guarantee that the seller will provide a credit.
That's not the promise.
The value proposition is simpler:
Spend a relatively small amount during the period when you still have options to learn information that could materially affect how you purchase, occupy or renovate a very expensive asset.
That is the real return on due diligence.
Think About the ROI Differently
Buyers naturally evaluate inspection expenses by asking:
“How much is this going to cost me?”
That's a reasonable question.
But another useful question is:
“What could not knowing cost me?”
Suppose environmental testing costs roughly one-quarter of one percent of the purchase price of a property.
That inspection expense may provide information affecting:
a $20,000 window-replacement project,
a $75,000 kitchen renovation,
a basement remodel,
an abatement scope,
a radon mitigation system,
contractor requirements,
or long-term maintenance planning.
The inspection does not magically make those expenses disappear.
It does something different.
It allows you to incorporate them into your decision before the asset becomes yours.
That is a very different value proposition than simply buying “another inspection.”
You're buying information at a point in the transaction when information has leverage.
The Best Time to Discover an Environmental Condition
There are two times to learn that the flooring you're about to demolish contains asbestos.
Before closing or after you own it.
There are two times to discover that the original windows you're about to replace contain lead-based paint.
Before you develop your renovation budget or after the project begins.
There are two times to discover elevated radon.
During due diligence or after your family moves in.
My preference is simple:
Know before you close.
What a Comprehensive Environmental Due-Diligence Package Can Provide
For an older Maine home, an appropriately scoped environmental evaluation may include:
Lead-Based Paint
Component-by-component XRF testing of applicable interior painted surfaces, with additional exterior evaluation when included in the scope.
Radon
Professional radon-in-air measurement performed according to applicable Maine requirements and recognized testing protocols.
Targeted Asbestos
Identification and laboratory sampling of suspect materials specifically associated with planned renovations or areas of concern.
Documentation
Clear reports identifying what was tested, where it was tested, what was found and what those findings mean within the inspection scope.
Actionable Next Steps
When conditions are identified, buyers can obtain appropriate contractor, mitigation, abatement or renovation guidance before making final decisions.
The objective is not a giant environmental report that leaves the buyer more confused than when they started.
The objective is:
Find it. Understand it. Plan for it.
Who Should Strongly Consider This Level of Due Diligence?
I would especially consider expanded environmental due diligence if:
the home was constructed before 1978;
you have children under six;
you're planning to have children;
substantial renovations are planned;
you're purchasing a historic property;
you're replacing original windows or doors;
you're renovating kitchens or bathrooms;
old resilient flooring, pipe insulation or other suspect materials will be disturbed;
the seller has limited historical knowledge of the property;
environmental disclosures say “unknown” or no previous testing exists;
you're buying a pre-1978 multifamily property;
or you simply want to understand the environmental characteristics of the property before taking ownership.
“Unknown” and “Negative” Are Not the Same Thing
This may be the single sentence I want Maine buyers to remember:
Unknown does not mean negative.
“No known lead-based paint.”
“No known asbestos.”
“No known radon problem.”
Those statements can be completely accurate.
But unless the relevant condition has actually been evaluated, unknown remains unknown.
Testing changes that.
This isn't about assuming that every older property contains an environmental problem.
It's about understanding the difference between:
“We tested for it and did not identify it within the scope.”
and
“Nobody knows.”
Those are very different information positions for someone preparing to make one of the largest financial decisions of their life.
A Better Due-Diligence Standard for Maine's Older Housing
Maine has an extraordinary inventory of older homes.
We shouldn't be afraid of them.
We should understand them.
A century-old Portland two-family can be an incredible property.
A 1920s Scarborough cottage can be an incredible home.
A Biddeford duplex, Westbrook farmhouse, South Portland bungalow or Falmouth Colonial may have generations of life remaining.
Older buildings aren't inherently bad buildings.
But they deserve a level of due diligence appropriate to their age.
Inspect the structure.
Inspect the mechanical systems.
Inspect the roof.
Inspect the electrical.
And when appropriate:
Investigate the environmental conditions too.
Because once you understand the building, you can make better decisions about buying it, negotiating it, maintaining it, renovating it and raising a family inside it.
Know what you're buying.
Know what you're renovating.
Know before you close.
